El PP, siempre atento a las demandas más arraigadas de la sociedad, ha presentado un modelo de seguridad que acabe con los okupa y antisistema.
COMBATIR LA CRIMINALIDAD Y AFRONTAR EL INCIVISMO
Otro de los ejes fundamentales de la Conferencia del PP “Más Seguridad, mejor Convivencia” es la lucha “sin cuartel” de la criminalidad. Para Ignacio Astarloa, es prioritario que no se instale la normalización de la criminalidad que se está instalando y ha advertido de un incremento extraordinario de la delincuencia durante el Gobierno socialista... “Tampoco nos podemos acostumbrar a que el gamberro sea el dueño de la calle en este país, a que se generalicen los fenómenos de conflictividad, de antisistema, de okupas, hasta el punto terrible en el que ha llegado con la actual Administración”, ha explicado el dirigente popular, quien ha recordado la suspensión de una Cumbre de Ministros de la Unión Europea en Barcelona “bajo el argumento de que no había capacidad por parte de las Fuerzas y Cuerpos de Seguridad para afrontar la protección de esa conferencia”.
Uno, en su ingenuidad, supone que para evitar que el gamberro sea el dueño de la calle, el PP propondrá la limitación del uso del automovil privado...
La cierto es que al PP parece no quedarle otro hueso que roer que los okupas y antisistema, porque el PSOE o, mejor aun, la voluntad popular, no le está dejando ni los restos en esto de apretar las tuercas del aparato represivo. La tramitación parlamentaria de la reforma de la ley Reguladora de la Responsabilidad Penal del Menor la está haciendo más represiva. Las (.pdf) enmiendas aprobadas en el pleno del Senado del 18 de octubre suponen, para más de 100 entidades que trabajan con jóvenes, un nuevo paso en el endurecimiento del tratamiento al menor infractor. El texto debe volver al Congreso, donde será rediscutido.
“Las asociaciones ya nos oponíamos a la reforma aunque sólo fuese porque se emprendió sin estudios previos que la avalen y desde premisas falsas, como el supuesto aumento de la delincuencia juvenil. Tras su paso por el Senado, va a peor. Seguimos con nuestra campaña de denuncia, aunque por ahora no tenemos planificadas nuevas acciones”, declara a DIAGONAL Patricia Fernández, abogada de la Coordinadora de Barrios.
Las enmiendas incrementan en general la duración de las penas y abren la puerta a internamientos larguísimos (de diez años). Y aumenta el recurso a la medida de internamiento cautelar, algo así como la prisión preventiva de adultos. Hoy, un menor que es internado así tiene un plazo de seis meses, en el que se le debe instruir el procedimiento y convocar a juicio oral. Con la reforma, el plazo se amplía a nueve meses.
Según Fernández, “el planteamiento educativo ha ido cediendo terreno a favor de la vindicación: se le da mayor potestad a la víctima y con ello a su ánimo de venganza. Al reforzar el peso de la acusación particular estamos dejando de lado el interés del menor para dar paso a otros intereses, igualmente legítimos, pero que deben quedar al margen. Se da pie a que la acusación controle la ejecución de la medida. Se obvian así otros cauces para que la víctima obtenga satisfacción en el proceso, como es la responsabilidad civil”. Además, se endurecen las condiciones del régimen semiabierto y de cumplimiento. Cuando un menor es condenado a internamiento en régimen semiabierto, la ley dice que el menor debe realizar alguna actividad fuera del centro, en cambio, la reforma de la ley habla de que podrá realizarla.
“Más tiempo, y en condiciones más duras”, concluye la letrada: “Además, más chavales van a entrar en los reformatorios, porque se establece el internamiento para delitos que antes no lo tenían aparejado”.

SalHaketa contra la reforma de la ley del menor.
Se repiten pues los errores del año 2003, que introdujo una reforma que endureció el sistema penal para mayores y que tan nefastos resultados está provocando, tanto de masificación (8.000 presos nuevos, de 56.060 presos a 64.164) como en niveles de reincidencia (60%), tal y como ha reconocido el propio Ministerio de Interior y la Fiscalía General del Estado.
Este error histórico, que tiene como origen la alarma social -creada artificialmente-, incitado por abordar las realidades conflictivas por el final y por lo que se está leyendo, se consigna en la Exposición de Motivos: “las estadísticas revelan un aumento considerable de los delitos cometidos por menores, lo que ha causado gran preocupación social”, y la existencia de una serie de disfunciones”, traerá lamentables consecuencias.
Téngase en cuenta que:
1.- En la comparecencia del Secretario de Estado de Seguridad el 1 de Marzo de 2006 se señaló una disminución de la tasa de delincuencia, y no un aumento.

2.- Las deficiencias apreciadas por el legislador y el gobierno, no son las realmente existentes, sino que son:
- La alta reincidencia (70% según los propios Centros) derivada del nulo resultado de los Centros de Reforma para la reinserción. De los 100 Centros del Estado español, solo el 25% son gestionados por la Administración. En Andalucía de los 17 Centros, sólo 1 es público (5,9%).
- El uso excesivo de la privación de libertad con los menores infractores. Más de 3.000 menores, de ellos 750 en Andalucía, se encuentran en Centros de Reforma. Lo que duplica al número de jóvenes privados de libertad, entre 18 y 21 años de edad, en Centros Penitenciarios 1.462 (321 en Andalucía).
- La falta de apuesta por el interés superior del menor y el carácter educativo previsto en la Ley.
La revisión planteada en el nuevo texto del espíritu contemplado en la Ley, no harán sino empeorar la tasa de delincuencia.

“en España existen 38.000 ONG’s, de las cuales, 11.000 se dedican a ayudar a niños y marginados”. Si estas 11.000 organizaciones, se dedicaran a apoyar al marginado y cuestionase al que margina, y se optase por un modelo anticapitalista, se podría acabar con la pobreza y con la desigualdad, y por tanto, con la mayoría de problemas que produce este sistema. Es necesario cuestionar al que margina para poder cambiar las cosas. Si no se cuestiona, es porque interesa que las cosas se mantengan como están, mantener las situaciones de marginalidad y pobreza, porque hay gente que sale beneficiada.
Mantener a un menor en el Zambrana interno, cuesta entre 40.000 y 50.000 pesetas (entre 240 y 300 €) al día. ¿Qué pasaría si ese dinero se diera a la familia del menor?¿O a alguna organización que se dedicase a trabajar con el niño? Las actividades arrancaban en Gasteiz a las seis de la tarde del viernes 22 con una charla titulada "De la criminalización de la pobreza a la cárcel de menores" a manos de un compañero de "Saltando Charcos" (Burgos). La gente de la web "Con los niños no se juega" ha usado el cartel que he pegado arriba para ilustrar la noticia que enlazo, pero el cartel original corresponde a la campaña por la liberación de los presos políticos de Oaxaca. Eso sí, es tan idoneo para denunciar lo de Oaxaca como para denunciar lo del Estado español. ¿Sería posible que en México hubiera algún funcionario de prisiones convencido de que los presos de España son víctimas políticas del sistema, mientras que los que él custodia son delincuentes que se lo merecen?¿Y viceversa?

Editorial: Luchar contra la cárcel es un tema complicado; lxs que ponemos nuestro empeño en acabar con esos antros de dolor y destrucción camuflados de falsas promesas de reinserción, nos encontramos con la problemática de la represión de forma constante. Hablar de las cárceles es un tema delicado por el calado social que tiene y por la ignorancia total de la mayoría de las personas de lo que es realmente esta institución. Hablar de cárcel no es hablar sólo de privación de libertad sino también de recorte de derechos o la total extinción de ellos, es hablar de torturas, palizas, violaciones y sometimiento atroz a un orden basado en la disciplina como arma de adecenamiento. Pero hablar de cárcel también es hablar de todas las dificultades para sacar a la luz lo que pasa dentro y de intentar meter dentro lo que pasa fuera. Está claro que si por información se entiende lo que la prensa y medios comunes ofrecen, a lxs presxs no les falta pues pueden disponer de ella sin demasiada dificultad –dependiendo del régimen en el que se encuentren- pero si por información entendemos aquello que al Estado y sus esbirros no les interesa que se sepa, entonces la comunicación o difusión de la información dentro de la prisión es casi imposible.
A la hora de entregar paquetes a lospresxs, la labor del carcelero, parece ser que no es sólo la de evitar objetos que puedan dañar en modo alguno a alguien o prevenir por la seguridad de los internos, sino también la de censurador. Cualquiera que tenga a alguien cercano encerrado conoce la arbitrariedad de estos tipejos, los objetos mas inofensivos corren el riesgo de ser rechazados dependiendo de la persona presa, su relación con los carceleros y el humor de estos en el momento de la comunicación (un simple cortaúñas puede ser de lo mas peligroso, aunque ellxs mismxs repartan cuchillas de afeitar…).
Queremos decir con esto que una publicación, fanzine, revista, o cualquier otra cosa que ellos puedan considerar “peligrosa” se queda fuera, ¿cómo puede ser peligroso un libro? ¿Desde cuanto la cultura hace daño a la gente? ¿Desde cuando las ideas han limado los barrotes?
Claro, lo que ocurre es que no sólo se pretende encerrar físicamente a las personas tras cuatro muros, sino que también se pretende que sus mentes, que sus ideas, queden congeladas o no puedan ser alimentadas con informaciones y cultura contrarias a su sistema. Además a aquellos que pretenden ayudar a lxs presxs, acercarse a las prisiones y mover en la calle el problema no se les ve con buenos ojos, es más, son represaliados, investigados y perseguidos por el Estado. Sólo aquellos que pretenden redimirlos, que van con la supuesta palabra de un supuesto Dios de la mano, siempre políticamente correctos claro está, pueden realizar algún trabajo dentro de la cárcel, que no deja de ser meramente asistencialista y que aunque haya algunos logros dignos de mencionar por su parte no dejan de ser subordinados del Sistema y sus represores.
Queremos escribir a nuestrxs compañerxs sin miedo de que nuestras cartas, nuestra intimidad sea leída con lupa bajo la intervención inquisidora de un carcelero, queremos poder comunicar con nuestrxs compañerxs sin que tengamos que esperar seis meses o incluso más para poder abrazarlos, queremos protestar, luchar, difundir sin miedo de formar parte del grueso de la población prisionera; queremos que de una vez por todas se pueda decir de verdad eso de que “existe la libertad de expresión”.
