¿De nuevo policías represaliados?
Siguiendo la estela de los policías que torturaron a dos miembros del PP, es de temer que los guardias civiles que detuvieron ayer domingo a dos antimilitaristas alicantinos -durante un acto del Mayo Caliente contra las instalaciones militares en la base de radares de la sierra de Aitana - acaben juzgados y expulsados; después de todo, la expulsión de los primeros ha sentado un interesante precedente -¿o no?-. No lo digo por el hecho de la detención en sí de los antimilitaristas, que son gajes del oficio desobediente, sino por las irregularidades que la acompañaron.

Los dos detenidos de Aitana, en libertad con cargos
Finalmente se les acusa solamente de un supuesto delito o falta de
Desobediencia. Un delito o falta -ya decimos aquí- que honra a quien está acusado de él. Según nuestras fuentes jurídicas, en el peor de los casos, y si fuera delito, y el juez o jueza fallara en contra se podría penar con un castigo de entre seis meses a un año (que en caso de no tener antecedentes
penales lo normal es que no implique ningún riesgo de entrar en prisión).
Joan de Alcoi, y Adolfo de Elx (y de Tortuga) han pasado por la cara una innecesaria noche en los calabozos de la policía local de La Vila Joiosa. Antes de ser detenidos era evidente que esa respuesta estaba preparada por
las altas instancias. Las supuestas diligencias que se les podían haber
practicado tras la detención se dejaron para el día siguiente con el fin de “joderles” y disuadir posibles antimilitaristas desobedientes el año próximo.
En la declaración ante la jueza de La Vila esta mañana los detenidos han causado sensación a causa de su originalidad, su coherencia política e incluso de su cierto punto de extravagancia en algún caso. Hay que decir que sus
declaraciones antimilitaristas han sido absolutamente claras y bonitas (próximamente serán publicadas en la web de Tortuga) y que en el caso de Joan han sido enriquecidas con su encendida defensa del uso de su lengua materna: el “catalán hablado a la manera valenciana”, como él decía.
Todo el mundo se sentía de buen humor esta mañana en los juzgados de La Vila, y nuestro antimilitarismo pensamos que –aparte de alguna pequeña tensión inicial- ha llenado de sonrisas, risas y buen humor a jueces, funcionarios/as, antimilitaristas, acusados/as, y hasta los Guardias Civiles que les custodiaban, que damos fe de que aparte de su triste profesión, eran muy majos como personas.

Al año del salto, multa al canto.
Desde el Grupo Antimilitarista Tortuga no vamos a recurrir esta sentencia... No es tarea nuestra una batalla judicial para que las leyes nos den la razón. Como activistas de la Noviolencia sabemos que nuestro enfrentamiento con el des-orden establecido necesariamente ha de pasar en ocasiones por el quebrantamiento de la legalidad vigente. Nuestra práctica de la Desobediencia Civil en la construcción de una sociedad desmilitarizada efectivamente está y estará en contradicción con las normas -se concluya de esa forma o no en un juicio-, pero firmemente tanto en nuestro derecho -y el de cualquier persona- a pisar y disfrutar la cumbre de la Sierra de Aitana como en la falta de legitimidad que tiene el Ejército para usurparla.pensamos que ésta es LEGÍTIMA Y NECESARIA. Eso es lo que le queremos decir a la sociedad en general, y a los/las jueces en particular. Como decía Henry Thoureau “la Ley no ha hecho nunca a los hombres ni una pizca más justos, y el respeto por ella convierte diariamente en agentes de la injusticia incluso a los hombres mejor dispuestos”. En la dicotomía entre legalidad y Justicia, nosotr@s optamos por la segunda, y a seguir este camino invitamos a jueces/as y personas en general.
Por último decir que un año más retornaremos a la Sierra de Aitana y realizaremos la que ya es la IV Marxa por su Desmilitarización. Es muy posible que nuevamente practiquemos la Desobediencia Civil...
