El Copyleft aprueba en los juzgados
Pues si, son ya 3 sentencias favorables estos últimos días a locales que emiten música bajo licencias copyleft ... Ladinamo, el disco-bar Metrópoli y la última al Buena Vistilla Club Social.
La SGAE por el momento no recurre las sentencias ya que no parece estar dispuesta a correr el riesgo de que las audiencias provinciales comiencen a ratificar sentencias favorables al Copyleft.
Eso si, en cada uno de estos casos los propietarios han demostrado que efectivamente la música que emiten en sus locales no está bajo la gestión de la SGAE.
Es importante que se haya superado esta primera prueba ...aunque la SGAE sigue con su campaña para establecer el canon compensatorio en el ADSL, discos duros y todo tipo de reproductores e impresoras.
La plataforma todos contra el canon están recogiendo firmas de apoyo contra esta nueva medida de extorsión que presentarán mañana en el senado

En el hilo de este artículo, han aparecido dos testimonios sobre el día a día de la difusión del conocimiento y los obstáculos a la misma.

Yo ingresé a la Universidad de San Carlos de Guatemala en 1996, cuando solicite una copia de Las Venas Abiertas de América Latina, de Eduardo Galeano, me dijo el Bibliotecario que todas las copias habían sido quemadas durante la ocupación de la universidad por el ejército en 1984.
Fue hasta 2002 cuando puede leer esta obra maestra de la literatura latinoamericana, es sencillamente enrriquecedora, la he leído cinco veces y no le pierdo el hambre por volverla a leer, a mi criterio debería ser lectura oficial obligatoria en todas las escuelas públicas de nuestro continente.

Yo soy estudiante de la Facultad de Humanidades de USAC en Guatemala y tambiém sufrí bastante para obtener una copia del libro, por cierto era una copia bastante desgastada pero aún legíble y valio la pena el sacrificio y la espera, ese libro me ha hecho entender tantas cosas del continente, como el caso Paraguay, Guatemala México, Venzuela, Nicaragua, por mencionar solo algunos.
Para mi ha sido el mejor libro que he leído, y el autor uno de mis favoritos.

Carta a Ramoncín
Quiero dudar que a día de hoy, Ramoncín, sepa cuales son las tácticas de recaudación de la Sociedad General de Autores a la que lidera en compañía de Teddy Bautista. Y por liderar una entidad a ciegas, se hace merecedor de todas cuantas críticas sea objeto, a fin de que se cuestione cual es su labor en dicha asociación y el por que rompe lanzas a favor de una entidad de tácticas fascistas y dictatoriales.
Quiero dudar que a día de hoy, Ramoncín, sepa que cientos de negocios familiares somos acosados por la sociedad que lidera, a los que nos reclaman cantidades millonarias sobre productos que compramos y vendimos desde 1999. Nos aplican el cobro del canon con carácter retroactivo, y nos lo exigen judicialmente en lugar de a los importadores y fabricantes, abogando por una extraña interpretación de “la cadena solidaria”, ¿solidaria? bonita palabra oída tantas veces en boca de Ramoncín.
Quiero dudar que a día de hoy, Ramoncín, sepa que tras gastar en abogados el dinero que con tanto esfuerzo gano para mantener mi casa y mi familia, la sociedad que lidera no se presentó en fecha, y mi demanda con amenaza de embargo quedó sobreseída, y quiero dudar que sepa que al día siguiente me interpusieron una segunda demanda en el mismo juzgado y por los mismos motivos, esta vez variando un formalismo jurídico para que les fuera aceptada a trámite.
No dudo que Ramoncín catalogaría este hecho de ensañamiento. Y no dudo que a poco que se pare a pensar, llegará a la conclusión que de nuevo he de gastar lo que no tengo en más abogados.
Para demostrar que en todo momento he cumplido con mis obligaciones como comerciante.
Para demostrar que la sociedad a la que lidera, hace una interpretación fascista y dictatorial del artículo 25 de la L.P.I en el momento en que exime de toda responsabilidad a fabricantes e importadores y osa venir a reclamar a un negocio familiar un impuesto con carácter retroactivo.
Para demostrar que la sociedad que lidera, hizo un acuerdo privado con esos fabricantes, que luego fue modificado con una nota aclaratoria (interna entre ellos) pero no en el B.O.E.
Y no dudo que Ramoncín sabe, que lo de los soportes digitales ya es antiguo, y ahora la historia se repite con grabadoras, mp3 etc.… y que la sociedad que lidera vendrá mañana a mi casa, por que con mi negocio ya habrá acabado, a pedirme ese impuesto tan necesario para su subsistencia como artista, y me lo pedirá con carácter retroactivo y yo tendré que pedir un préstamo para que los abogados me ayuden a demostrar que a día de hoy, los fabricantes e importadores niegan que las grabadoras lleven canon, eso unos, otros dicen que ya lo paga el fabricante, pero ni unos ni otros me incluyen en factura una línea que me salve del acoso de las Sociedades de gestión.
¿Creerá Ramoncín, que llegados a este punto me pueda consolar la frase de…”Tranquila, a embargar tu casa no llegaremos”?
Y si todo esto no le hace a Ramoncín cuestionarse cual es la sociedad que lidera, y que su sistema de cobro es irracional, injusto, fascista y dictatorial, será la confirmación de que todas mis dudas anteriores sobre su persona, no son tales.
Y mi odio hacia él y otros muchos artistas a los que yo consideraba cerca del pueblo y a los que justificaba en su lucha contra la piratería, solidarizándome con un gremio en crisis, ese odio, será completo, eterno y visceral. Pues les hago responsables de mi ruina económica y personal como líderes mediáticos de una sociedad de gestión que actúa al más puro estilo fascista y dictatorial, adjetivos que tanto repito para vergüenza de aquellos que se enorgullecieron un día de los cambios políticos de nuestro país.

Un juez niega que la SGAE pueda cobrar por toda la música

La SGAE pierde un juicio contra una cafetería que pone música "libre" bajada de Internet
El Juzgado de Primera Instancia número 4 de Salamanca ha absuelto a la cafetería Birdland de dicha ciudad en el juicio por la demanda presentada en su contra por la Sociedad General de Autores y Editores (SGAE). La entidad de gestión, a la que se le ha impuesto las costas del juicio, alegaba que el establecimiento utilizaba obras de su repertorio musical. Sin embargo la defensa ha logrado demostrar que las canciones eran bajadas de Internet y bajo las conocidas como licencias libres. Es la cuarta resolución favorable al Copyleft en España.
Entre las pruebas presentadas por la SGAE estaba una grabación realizada por una agencia de detectives en un local diferente del demandado, según explica el sitio web Derecho de Internet. De hecho, en la propia sentencia se señala de la misma que "poco hay que decir al referirse a otro local". El fallo judicial es duro con las evidencias presentadas por la Sociedad General de Autores y Editores y recuerda que es a la misma, como demandante, a quien le corresponde demostrar que las canciones reproducidas en Birdland son de su repertorio.
La sentencia, en la que se desestima la demanda, afirma que se "ha generado hasta ahora la sensación de que la SGAE tiene un derecho a la gestión exclusiva del repertorio universal de las obras musicales". A continuación añade: "Sin embargo, en los últimos tiempos está alcanzando en nuestro país cierto auge un movimiento denominado de "música libre", muy relacionado con la expansión de Internet como medio de distribución musical".
