Lawrence Lessig, abogado y profesor en la Universidad californiana de Stanford, es uno de los principales teóricos de un copyright alternativo, un tema de actualidad a causa las batallas legales originadas por las masificación de las copias digitales y la distribución de música y otros contenidos por Internet. Lessig asegura que quiere liberar a la cultura de los excesos del modelo de copyright actual y de un concepto sobre la protección de contenidos que no encaja con la sociedad digital. Es una visión que no implica ninguna apología de la piratería y que Lessig argumenta detalladamente en obras como Por una cultura libre.

Las licencias Creative Commons son utilizadas por más de un millón de productos culturales (canciones, libros, películas, programas informáticos, etcétera) y básicamente permiten la reutilización, distribución y copia del material sin fines comerciales, apoyan el uso creativo y social de los contenidos y salvaguardan los derechos de autor. David Byrne (ex Talking Heads), el grupo Beasty Boys y Gilberto Gil, actual ministro de Cultura de Brasil, son algunos de los artistas que lo apoyan.
La Creative Commons Developing Nations License es la última entrega del proyecto y consiste en una propuesta radicalmente nueva. "Cuando el autor lo decide, determinados productos siguen bajo el amparo del copyright típico en los países ricos, pero pueden ser copiados y distribuidos libremente en países en vías de desarrollo", señala Lessig.
"En el debate mundial que hay sobre el copyright, quienes proponemos nuevos fórmulas somos vistos por mucha gente como defensores de la piratería y partidarios de que los artistas no cobren. Esto es erróneo. Lo único que buscamos es un sistema nuevo que aproveche las facilidades de distribución y creación que brinda Internet. No queremos abolir el copyright ni dejar a los artistas sin cobrar. Cuando Bill Gates dijo que éramos unos comunistas que queríamos destruir la propiedad privada, lanzó una idiotez malintencionada", explica Lessig a este diario.
El abogado norteamericano comenta que existe un plazo para que la situación cambie. "Tenemos cinco años. Si no lo logramos, las nuevas tecnologías de control que se están preparando y una legislación cada vez más restrictiva ejercerán un poder como nunca se ha visto sobre la cultura."
Lessig mantiene también una visión pesimista sobre las repercusiones del reciente caso Grokster y el fallo del Tribunal Supremo norteamericano culpabilizando a las redes P2P. "Es una sentencia que no separa la tecnología del uso de la misma y cuyos resultado será muy negativos: podría congelar el desarrollo tecnológico de Internet durante los próximos 10 años", explica. Lessig afirma que "la reacción oficial es tan furibunda como la que hubo hace siglos sobre el uso de la imprenta".

Lawrence Lessig, abogado y profesor en la Universidad californiana de Stanford, es uno de los principales teóricos de un copyright alternativo, un tema de actualidad a causa las batallas legales originadas por las masificación de las copias digitales y la distribución de música y otros contenidos por Internet.
